Reversal of Judgment On Appeal

Rick Hall and Douglas Hargett were hired as appellate counsel for a director of a corporation who had lost a trial involving the corporate opportunity doctrine, resulting in the imposition of a constructive trust over a business which he and others owned. On appeal, the firm was able to obtain a reversal of the judgment and remand for a new trial regarding the constructive trust. See Mitchell v. Aqua Marine Enterprises, Inc., 274 So. 3rd 251 (Ala. 2018). The case thereafter was settled on terms acceptable to all parties.
